[592] NCO FINANCIAL SERVICES - SCAM COMPANY - NEGLECTS THE FTC

I have been receiving numerous harassing telephone calls from this Company and although I informed them that they had the wrong number (Which I recorded) - They continue calling using a computer and pre-recorded messages telling me to call them back. I will be posting the recorded message soon. I have filed a report with the FTC regarding the harassing phone calls as it is against the law to harass in any type of debt collection - But dam, they're calling the wrong number and despite having informed them of that they are calling the wrong number, they continue calling....

Talk about a violation of the law. I have noticed numerous other complaints about this company on the internet. I think it is time that someone speak to an attorney about this and taking legal action including a class action law suit.

According to the letter of the law, DEBT COLLECTION PRACTICES [Fair Debt Collection Practices Act] - Harassing phone calls are illegal, especially when they continue calling the wrong number!

  • Below is another complaint I read about this company regarding harrassing phone calls. Here is one way to take care of this.
    1. File a police report.
    2. Submit the police report to the FTC.
    3. File a civil suit with the Secretary of State.
    4. File tons of complaints.
    5. Contact Attorney regarding class action lawsuit.
    6. Put up a website devoted to NCO Financial Services and have a petition for class action law suit.

    Things to note, NCO Financial Services was recently fined over a million by the FTC. If the FTC continues getting word that they are harassing people which does go against the Fair Debt Collection Practives Act, The FTC will fine them again or shut them down completely.

    Hi,

    After getting harassing phone calls from NCO Financial Services, I did a web search and your site popped up. You might find this interesting.



    Various people have been calling my mother's phone number and leaving messages for me on her answering machine once or more times per day EVERY DAY. All they leave is their name, phone number and extension. Out of curiosity I called that number (800-227-4000) and the machine identified them as NCO Financial Services. Evidently they have done this before and my mother called and talked to them. She believes this is in regard to my student loan. To know why this is soooo wrong, you would have to know the history of this bill.



    I was approached by a person with a flyer in 1988. The flyer claimed that if I went to that school that upon graduation they would place me in an office job for $12 per hour. That was much more than minimum wage or welfare. I got the maximum grant allowed and took out a student loan. After graduating with honors I couldn't get job placement in an entry level job that paid $8 per hour. The perspective employer told me my certificate was worthless.



    The student loan people started trying to collect not long after that. The original amount was over $2000. Over the years they transferred ownership of my loan several times and periodically harassed me for payment. I found out that according to federal law I qualified for a waiver for several reasons. I was lured to the school with false promises, therefore, I was tricked into signing for the loan by fraudulent means. The fraud being that they promised education, certification, job placement, and a high wage. I got nothing. The school closed down. I was on welfare, sick and becoming disabled. I wasn't working.



    Yet, they continued to harass me. Eventually someone calling themselves the Department of Education and Justice started with proceedings. They claimed to have taken me to court in another state and wanted nearly three times the original amount of the loan. Evidently this is the federal guaranteed part. Whenever I talked to an individual about my situation, they agreed that the loan should be forgiven for the reasons I've already stated. Yet, although they all claimed to see what they could do, big brother won out in the end.



    In the mid '90's, I finally had a job and an apartment. I was working nights at a Shell station for minimum wage. Not a glorious or even safe job, but I was trying my best. My car broke down so I was walking to work in the dark. I owed a deposit on my utilities that I had to pay or they'd be shut off. But that was okay, because I was about to get a tax return that was big enough to fix the car and pay the deposit. The tax return never came. I never got a tax return again. The IRS was now acting as bill collector and treating me like a tax evader. They took enough to cover more than the principle with interest, but they called it all interest and continued to bill me until the amount owed was more than doubled again. That means if I paid it today I would have paid four times the original loan for a school I attended in 1988 that defrauded me, undereducated me, didn't place me in any job, and later closed down.



    I made the mistake of writing a nasty letter to the Department of Education and Justice, telling them how they'd ruined my financial life and so forth. After that, I couldn't get any government services for quite some time. I am referring to social services, drivers license, state ID, appointments in county medical facilities, and so on. Every time my name or social security number was put into a government computer there were false accusations, confusion, misleading information and chaos. I eventually called these people to talk about it. I called not only to see if I could have the loan considered paid for what they IRS already collected, but to apologize for what I said in the letter.



    They claimed to have no file on me and didn't know what I was talking about. Yet, they made several comments that included personal information about me they could only have if they did have a file on me. So I restated my apology and tried to smooth things over with them. They refused to reduce the loan to the amount paid. They continued to claim they only took interest and that I still owed the principle. They also tried to make it sound like they could leave this on my credit for as long as they wanted AND that they were not responsible for it being on my credit. However, after that I was able to get ID and there was less confusing information in the government computers about me. I still can't get SSI or other social services however, and I believe this event played a part.



    Another problem I had was that the loan continued to show up on my credit report. I thought debts could only be on my credit report for 7-10 years, and that if I disputed the debt and showed proof that it was fraudulent, they would take it off. But they don't follow the rules and essentially do whatever the hell they want. I am pretty sure it is still on my credit 16 years later. If it was a legitimate bill for a real school that didn't rip me off and I was a successful person because of them, I could understand. But they took advantage of an unhealthy single mother on welfare and essentially ruined my financial life and still flaunt it by harassing me and my family and putting it on my credit report.



    Is there any thing you can do or someone you can direct me to who can help me with this problem? If so, I would appreciate it. If not, thank you at least for exposing part of the problem and for taking the time to read my story.

  • I hate to say it, but i worked or NCO a few years back, I was told when I worked there that any means to collect the money was fine with them, i quit there because i did not like the practices of this company. I have worked in the past for other collections companies and never was i treated with disrespect as I was at that company.

  • NCO is calling me everyday, at various times, with the pre-recorded message to 'call them back'. Thanks to caller i.d., i let the call go straight to voice mail. Now, they are calling, but caller i.d. says it's TIME WARNER CABLE. ?????? has anyone else had this situation happen to them? signed, annoyed in america

  • NCO Financial Healthcare division recently hired me as a collector. There is an intensive training the first week you start, requiring you to read the FDCPA, Fair Credit Act and Hippa. Then you are tested on each subject. If you do not pass the test, after extensive one on one training, you and management discuss if a collection position is the best fit for you. I passed all 3 tests my first time. They have SUBSTANTIAL regulations and policies regarding collection practices and in this economy, where many are unemployed, NCO works with consumers to possibly find other money sources to assist them with their debt. You are also trained extensively on which accounts are collectible and which are not. NCO is not allowed to collect on any service people, unemployed consumers who have no assistance (collectors are given a variety of options of assistance if the client allows it) and at the office I work at, collectors are trained to assist consumers in debt. I understand that there are many branches of NCO and many employees do not follow policy and as a result, if a collector violates a policy or the law, the collector is financially responsible for a portion of any lawsuits and/or violations. No one likes collectors calling them and from what I've read, most of you have had the misfortune to get the employees of NCO that should not be working there. Yes, we have a base we have to meet monthly, but if a debt is incurred, it should be paid - morally if not legally. Third party calls (calls to relatives, friends looking for skip tracing information) is proceeded with caution and all state laws are required to be followed also. If you receive a call from NCO and it's wrong, collectors are required to take appropriate action to make sure it doesn't happen again. Collectors are only allowed to contact consumers 2 times per week if a message is left or actual contact with the consumer is achieved, and are not allowed to harass or abuse the consumer. If you encounter someone like this, contact the site General Manager and Corporate. I can guarantee that your complaint/issue/bad call will be dealt with internally and fairly to you. Plus - I've been on the end of debts I can't pay and receive collector calls - I've never received any calls like the issues noted here.

  • To the person who supposedly works for NCO.... Your company is a sleaze-bag operation. They call our house at least twice a day. I've told them the person they are looking for does not live here and never has lived here. Still, they keep calling. So not only are they obnoxious but they are stupid too. Do they expect my answer to change if they keep calling? It's plain and simple harassment. My hope is that they go out of business.

  • Just got ANOTHER call from these people. I finally started researching the laws. One call came in yesterday my account, walmart, is mearly 2 months delinquent, hes asking me to postdate a $15 check. I say i cant do that. he asks me to settle with a lower amount, I say i cant do that. I remind him that I make no promises, no post dated checks. He reminded me he cant do anything to stop the calls then. and that he'd call back on the 25th asks me whats a good time for him to call? i said around 1pm. He reminded me to ONLY pay him. That prompted me to say," so IF i walked into walmart and offered payment they wouldnt take it? he said oh they will but your debt is with us now. It wont bring the account current....end of call....so he calls back at 1pm asking if i came up with the $$$. i said huh? its not the 25th you said you were gonna call back on the 25th @ 1pm!he "apologized" for the misunderstanding. I then get a call from them again this morning asking if i was gonna make my payment, i got irrate! demanded to speak to a supervisor, proceeded to tell her about the discussion that took place yesterday and i wanted that employee repremanded for lying on me. she told me that i DID make a promise by stating if i had walked into wamart and made a payment would they accept it. thats a promise she said....i told her that if she understood english she would understand that what i said was Hypothetical and no where near a promise. i told her the word "IF" is not a promise....so we argued over the word if, promise and current. then she informed me in advance that "you may recieve another call from us today" i said for what? you made contact you have to disposition the call correctly, you cant call me again! she said " i know its illegal" thats why im apologizing for it now. She said the agent that called you did it manually and you number is in the pool for auto dialer so you may recieve another call today But im gonna try to stop it before it happens, ok? i said well you better hope i dont recieve another call, im going to be doin my research to see what the laws are cause you will hear from me if your not supposed to call again. and i just may be paying off my walmart bill sooner then i thought. she said " I told you i know its illegal, Im willing to settle for a 200.00 payoff now is that what you want? I said no i told you im not in any position to pay at this time! she said well 15.00 i can bring your account with walmart current, i said again, no. she apologized again. I rememberd to ask for the agency name and number that the call was comming from wrote that down then ended my call and came to search on NCO. I wish i had documented all calls from them cause there has been alot that way i could contact the atty who posted above.....

  • This company has been calling my home quite often. I finally answered them this morning and the woman on the other line gave my mother's name as the person they were looking for. I informed her that my mother did not reside at that number and wanted to know what the call was regarding. She informed me that since I was not on the account she could not discuss that with me. She wanted my mother's phone number which I refused to give her and told her that I would pass her phone number on. The so-called policy that they are only allowed to call a consumer two times a week, is not true. I will be providing my mother with the attorney's information listed above.

She became hostile and informed me I have no rights only what NCO states and that she will issue a refusal to pay and that there is a warrant for my arrest issued by NCO via the internet as they have connections to police departments in Texas! Now what?

  • I worked for NCO Financial Services for about two weeks. I resigned because of how low class they are, they will hire any and everybody. The employees continually smoke marijauna and drink alcohol. When they hire a person he or she is NEVER given a drug test. They are trained how to harass people, their mindset is the more you bother someone the more likely they will pay up. These employees are screened during their outbound calls, not for the consumers protection but NCO's protection. They really need to be driven out of business.

  • I received a call from NCO saying that I have a medical bill of $355from June 28th, 2009. They wouldn't even give me the name of the medical services but gave a name of a foreign doctor I have never even heard of. Not only this company does harrassment phone calls, they make up bills and scam you, trying to get your money. BE CAREFUL!!! They are really a collection agency but they scam people too.

  • My husband and I both have excellent credit, pay our bills in full, and on time. In the past year, we've gotten calls asking for my husband's relatives, but I'm not sure if they were from NCO then.

    In the past month or two, we've been getting daily or twice daily calls from NCO. We've never called them back and always have our machine pick up. I don't call companies back when they don't say why they're calling, and they just say it is "regarding an important business matter". After looking them up online I saw that they may be a collection company, but also scam artists. I know for certain that we don't owe any outstanding debts. I'm anal about paying bills in full and on time. I'm so upset about all this harassment that I'm ready to call the police, talk to a lawyer, and change our phone number too. UGGGHHHHH.

    do have to admit kinda funny reading some of these. im in ohio office to be exact and the people here are awesome. i think most people are just geting the bad collectors..its not the companies fault. if you truly feel your being "harrased" then simply pick up the phone and tell us wrong numbr dont know the person..

    for thoes who do and still get calls, well honestly your just unlucky, there are alot of cases where the same phone number will come over to us on different accounts. and trust me when i say, we have no idea unless we look up that specific phone number out of the hundreds and thousands of numbers we get every week.

    i do understand tht NCO has been in lawsuits where the customer was scamed but again.. that was the collector who did the scam not NCO-s fault.

    rly i guess what i want to say is.. dont blame the company because the person you unfortunatly dealt with is a bad collector. keep in mind, we are people too,, with lives were not robots who do this evryday all day.

  • after reading this i am ashamed to be american! how can this company get away with all this bullshit? they call us everyday and hang up if we answer...hang-up. that's it! no message, nothing. then when we call them back they know us by name and start trying to collect $ but won't tell us for what or why??? i am filing a police report and filing a report with the FTC. what a bunch of crap! shame on our governmant for letting this bullshit company prey on their unknowing victims!

  • I am conftonting an issue with NCO that is unlike anything I have seen mentioned. Yes, they have harassed me. That I can deal with. Really. What they have done is far worse than that. I am in default on approx. 130,000 worth of student loans and have been for some time. They have repeatedly insisted that I must pay nearly 1,000/month to get them out of default. I have contacted the dept. of education and have been told by them that this is not the case and that NCO must work out a payment arrangement with me. I actually went through a whole process with the dept. of education nearly a year ago, filling out forms indicating my income, expenses, etc. Dept. of Ed. determined that I'd pay 100 per month on my loan for now and thereby get it into rehabilitation. After much struggle NCO complied. Now they are going back on their word saying that such a measly payment has done nothing to get my loans out of default and are once again telling me I must pay 1,000/month. Once again I called dept. of ed. and once again was told that, no, I do not have to pay that to get them out of default, but rather an amount that is affordable to me. This is absolutely maddening. NCO refuses to acknowledge what the dept. of ed. is telling me. I don't know what to do. I simply want my loans to come out of default and cannot pay 1,000/month and according to dept. of ed. shouldn't have to either. Can anybody suggest whom I might see about this? An attorney? Or someone else?

  • I dont' even have a debt with them, and they continue to call me. I am thinking that someone who use to have my phone number has or had a debt with them. No matter how often I tell them, they won't stop calling. I don't even get a person. They call and say...This is NCO financial services, a debt collection agency. Please call us at 1888 bla bla bla. If they have a debt that needs to be paid, then send me a bill, or call me personally. Stupid people. If I were a company looking for a collection agency to hire, it wouldn't be them, thats for sure.

  • do a web search for Kirk Leidemann on google and pull up his Linked profile...he is currently a NCO collector.....now look down and see that he used to be a cop. What he doesn't tell you in his Linked profile is that he was fired from the cop job for harassing people of color in a totally inappropriate fashion....so NCO in addition to hiring ex-felons also hires ex-cops who are just as "unstable".

  • Blame the skip tracing for most of the harrassing calls. I had a different debt collector come after me for a debt that wasn't mine. I tried to call them to explain but was unsuccessful. So I wrote to them. They wrote back as tho they never read my letter and demanded payment. I wrote to them again. This went back an forth until they filed a lawsuit to try to collect. Then I was forced to hire an attorney. Luckily, the correspondences were in writing mostly so we were able to prove how inept they were. After discovery, we learned that the skip trace company produced me as the most likely debtor by a certain percentage. The actual debtor was not even a relative, just some one with the same name as me. With a little online searching, the debt collector would have realized he had the wrong person, but that would have taken effort. They work the BS game...throw enough of it against the wall, some is bound to stick.
